Car Insurance - should they pay out to a criminal?

If your local drug dealer is driving along at 29mph in a 30mph zone, his car is taxed and insured and his licence is valid and has no points, but a car pulls out of a side street into moving traffic and hits the drug dealer's car causing a serious injury to the drug dealer...

Should the insurer of the 'at fault' driver be able to not pay out if it is discovered that the drug dealer was transporting illegal drugs in his car at the time of the crash?

Has the dealer been 'caught red handed' with the drugs?

Or do you just 'know' he is a drug dealer?

unless he has been caught, the insurance company will be non the wiser as id imagine questions about involvement in organised crime are rare on car insurance forms.

There is a case of this nature in the news. The police were at the scene attending the accident. They found drugs in the car of the injured man who was not at fault for the accident. The insurance company don't want to pay out because the car/injured man were involved in carrying out an illegal activity at the time. I suppose its in the same sense that your own insurance doesn't cover you if you are carrying out illegal activities at the time of an accident.

The EU are saying that the insurance should pay out, the insurer in Britain is saying they don't have to pay.

Depends what kind of insurance the drug dealer has. If his insurance only covers social,pleasure and domestic they shouldn't pay out. If he has business insurance ( covering deliveries) then they should. Would be the same if he was delivering a pizza with wrong insurance.
