Can employer reduce my hours but increase my days for the same pay?

I finish work at 9pm every night. 
At the moment business is slow and we don't get many sales after 8pm. Between 8pm and 9pm sales are maybe half the average.  

I am in a salaried job.

My employer (I have heard) is considering making my days an hour shorter every day but making me come in for a 5 hour shift for an extra day per week. But for no change in pay.  

Is this allowed?


It doesn't feel right to me. Finishing at 8 or 9pm is more or less the same. You have already used that entire day/evening for work. So to get an hour back per day but come in 10-3 on  a Saturday feels like giving a whole extra day for nothing. Would you feel the same? Aren't slow periods just part of the job? 

McDonalds doesn't close after lunch because sales dip.

Think they would have to give you written notice of change in contract and time of change. However being in a "nasty" union does have its benefits and a phone call would have put you straight.
My daughter had a month off for an operation and got a written warning!? The union got it removed from her record. One of her mates had similar but unfortunately it still remains on her record, she chose not to be in.
Things won't get any better when one of Thatcher's disciples takes over. Leadsom, a practising Christian, will bring back fox hunting, stop gay marriage, cease minimum wage and maternity leave in "small" companies, all without the shield of the EU.

This is just off the top of my head now so it may not be correct but my understanding's always been (and it's what I've done in the past when implementing changes to shift patterns, etc) that if it's a fundamental change to your contracted hours, your employer is required to give you 90 days statutory written notice of said change.

It doesn't really mater if you agree with it or not, once the 90 days are up, you're doing it.

Ok. I can take that.  

I expect they probably can do it and I will survive... 

I guess my main thoughts when pushing the question were wondering how people would feel about it. 

A five day week effectively becomes 6 days - but for no change in money...  Yes I finish an hour earlier but having to turn out an extra day is the thing that feels hard. 

Would an average office worker think it was ok to finish at 430 instead of 530 but they had to do 5 hours on a saturday to make up for it? 

I am wondering how other people would feel and if it's just me or would anyone feel a bit put out?

I would feel pissed off to lose a day off every week as well to be honest, you have the extra expense of travel on top as well that you wouldn't otherwise have had to shell out.

It all boils down to the fact if you enjoy the job and the money is good to make it feel more justifiable  but if your boss is a cock and it's shit pay and it's a million miles away from your home then you can always see what other jobs are out there. Smile

You're right to be aggrieved because it is a massive shift in your work/life balance but unfortunately you're not in the strongest of positions to deal with it.
If you cause waves about it then while they can't immediately just sack you, having your card marked isn't something you want moving forward.
Unless there are any experts on employment law on here a couple of suggestions would be to have a meeting where you discuss difficulties this could lead to or possibly try speaking to the citizen's advice bureau who will have access to statutes relating to it.

Good point, because of the fear of change it's easy to stay somewhere you are undervalued. I was in that position a couple of years ago where i was in a job which the morale was deteriorating by the day but because the pay was decent I felt trapped.
The decision was taken out of my hands when the business closed its local operations down, what I realised then was that if you have a good work history and can demonstrate qualities employers are looking for it can work in your favour, it did for me.
Don't undervalue yourself register with some online agencies and see what's out the - and good luck.

are they asking you to work on Saturdays? Would you get an enhanced rate for doing weekend or unsocial hours?

Reading the post and the fact it was talking about the fact that it was open till 9 and referring to sales I assumed it was some type of retail or wholesale business in which case certainly Saturdays and often Sundays don't pay an enhanced rate for weekends as they are classed as business critical hours and are on rotor with all the other hours - I think

I interpret Biggie's comments as relating to telesales or online sales rather than retail sales WGO - perhaps he might clarify.

My understanding is that they can do it with notice and - depending on the nature of the business - have no obligation to increase pay if the total hours are the same.

If it isn't what you want don't be afraid to stand your ground, make up commitments that you have on Saturday.
And if they don't budge don't be scared of change and have a look around. People talk about the fact there are no jobs, it's bollocks there are jobs you just need to show you're worthy of them. Get yourself on LinkedIn, Monster, Indeed, Top Jobs and if it is retail check the Grocer magazine and website.
