Fact is he was standing over a student whose pants had been pulled down.

Assumption is that he had done that and possibly on way to do other things.

Law is based on fact only.

Im not really assuming anything, you don't get jailed for 3 years by innocently standing.

I think its always been illegal to break into someone's house, and pull down their trousers for sexual pleasure. And certainly makes him clearly more of a sexual predator than his peeping tom episode.

I wasn't inferring he was going to rape her, its just pretty obvious he had his pants down as well.. or at least his fly..
